¿Qué hacer si tu aseguradora no paga?
Cuando contratamos un seguro, lo hacemos buscando respaldo y tranquilidad ante situaciones adversas. Sin embargo, no es raro encontrarse con aseguradoras que, llegado el momento del siniestro, retrasan el pago, lo niegan o imponen obstáculos poco claros.

1. Reuní toda la documentación

3. Revisá las cláusulas de tu póliza
Con el apoyo de un profesional legal, analizá si los motivos del rechazo se ajustan a lo pactado en la póliza. Es frecuente que existan cláusulas abusivas o de difícil interpretación, lo que puede invalidarlas legalmente.
4. Enviá una carta documento o intimación formal
Antes de iniciar acciones judiciales, se recomienda enviar una intimación formal a la aseguradora, exigiendo el cumplimiento del contrato bajo apercibimiento de iniciar acciones legales por daños y perjuicios.
5. Accioná judicialmente si no hay respuesta
Si la aseguradora mantiene su negativa o no responde en los plazos estipulados, se puede iniciar una demanda por incumplimiento contractual. En muchos casos, también se puede reclamar daño moral, intereses e indemnización adicional.
6. No te dejes intimidar
Recordá que la ley te protege como consumidor. En muchas jurisdicciones, las prácticas abusivas de aseguradoras están especialmente sancionadas. Contar con asesoramiento legal especializado es clave para hacer valer tus derechos.
